On February 2025, the Supreme Court of Justice of Mexico, ruled on a case of gender identity discrimination. The Court ruled that a shopping mall in Mexico City violated the rights to equality, non-discrimination and gender identity by denying access to public restrooms to trans women.

In December 2024, the Mexico City Anti-Discrimination Council, at the request of the organized civil society of Mexico City, issued an Advisory Opinion 02/2024, on “Discrimination against trans and non-binary people in the use of public restrooms in Mexico City”, due to cases reported to the Council on the denial of access to public restrooms in shopping malls in Mexico City to trans women and non-binary people. Through the Opinion, COPRED argued that denying access to public spaces to people based on their gender identity contravenes the provisions of local, national and international law, since it violates the rights to equality and non-discrimination. It should be noted that this Opinion was considered by the Supreme Court to resolve the case in question.
